Overtime Laws in Atlanta
Overtime laws in Atlanta and throughout the State of Georgia are relatively simple to understand. While there are numerous exceptions, generally speaking:
- Employers with business revenues greater than $500,000 are required to pay overtime wages.
- Employees engaged in interstate commerce (including regularly making interstate telephone calls and faxes, and taking orders from other states over the Internet), are required to be paid overtime wages.
- Full-time hourly wage-earning employees who work more than 40 hours in a given workweek are entitled to overtime pay.
- Generally, overtime pay is equal to 1.5 times normal wages and value of benefits, e.g., if you make $10/hr regular pay, your overtime pay is $15/hr.
Employees do not have to do anything special to qualify for overtime pay. It should be calculated automatically the moment working time for the week exceeds the 40-hour limit.
Getting the Money You are Owed
Employees throughout the Atlanta area and throughout the entire country are often denied overtime pay. Some employers proffer the excuse that they do not pay overtime as a matter of company policy. Other businesses approach employees and ask that they work off-the-clock or be paid "under-the-table" for additional hours as a favor to the company. These practices are illegal and employees are entitled to their overtime pay even if they consent to these practices.
If an employer or employee meets the requirements outlined in the Fair Labor Standards Act (FLSA), the employer must pay their employees overtime. We help people claim their overtime wages by filing lawsuits against their employer. Contact our firm to find out how we can assist you.
